BY PURCHASING, INSTALLING, OR USING ANY DETIKO PRODUCT OR SERVICE, YOU AGREE TO THESE TERMS AND CONDITIONS, INCLUDING A BINDING ARBITRATION CLAUSE AND A WAIVER OF CLASS ACTION RIGHTS AS SET FORTH IN SECTION 13. IF YOU DO NOT AGREE, DO NOT USE OUR PRODUCTS OR SERVICES.

1. About DETIKO
DETIKO is a smart camera brand headquartered in Hong Kong. We design and sell window cameras—including outdoor/indoor security cameras, bird feeder cameras, and related accessories and software—primarily for the United States market. Our mission is simple: to help you see what matters, clearly and in real time, with no overcomplication.
DETIKO products and services are provided by DETIKO Limited ("DETIKO," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your purchase, installation, and use of all DETIKO hardware products, mobile applications, cloud services, and websites (collectively, "Services").
2. Acceptance of Terms
By accessing our website, placing an order, downloading our app, or using any DETIKO product or service, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy (available at DETIKO.com/privacy). If you do not agree, please do not use our products or services.
We reserve the right to update these Terms at any time. We will notify you of material changes via email or an in-app notice. Your continued use of any DETIKO product or service after such changes constitutes acceptance of the updated Terms.
3. Eligibility & Account
3.1 Age Requirement
You must be at least 18 years of age to purchase or use DETIKO products and services. By using our Services, you represent that you are 18 years of age or older and have the legal capacity to enter into a binding agreement.
3.2 Account Registration
Certain DETIKO features require you to create an account. You agree to:
l Provide accurate, complete, and current registration information;
l Maintain the security of your password and account credentials;
l Promptly notify us at support@detiko.com of any unauthorized access or use of your account;
l Accept responsibility for all activities that occur under your account.
DETIKO reserves the right to suspend or terminate accounts that violate these Terms.
4. Products & Orders
4.1 Product Descriptions
DETIKO strives to describe its products accurately, including specifications, compatibility requirements, and features. However, we do not warrant that product descriptions are error-free, complete, or current. We reserve the right to correct any errors without prior notice.
4.2 Order Acceptance
Placing an order on DETIKO.COM constitutes an offer to purchase. DETIKO reserves the right to accept or reject any order at its sole discretion. Your order is confirmed when you receive an order confirmation email. We may cancel orders due to product unavailability, pricing errors, or suspected fraud, in which case we will issue a full refund to your original payment method.
4.3 Pricing
All prices are listed in US Dollars (USD). Prices are subject to change without notice. Applicable taxes and shipping fees are calculated at checkout. In the event of a pricing error, we will notify you and give you the option to proceed at the correct price or cancel your order.
4.4 System Requirements
DETIKO cameras require a stable Wi-Fi internet connection, a compatible smartphone (iOS or Android, as specified in the product documentation), and the DETIKO mobile application. It is your responsibility to ensure compatibility before purchase.
5. Shipping, Returns & Warranty
5.1 Shipping
DETIKO ships to addresses within the United States. Estimated delivery times are provided at checkout and are not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control.
5.2 Returns & Refunds
We offer a 30-day return window from the date of delivery for unused, unopened products in their original packaging. To initiate a return, contact support@detiko.com. Return shipping costs are the customer's responsibility unless the return is due to a product defect or error on our part. Refunds are issued to the original payment method within 10 business days of receiving the returned item.
5.3 Limited Warranty
DETIKO warrants its hardware products against defects in materials and workmanship for a period of twelve (12) months from the original date of purchase ("Warranty Period"). This warranty does not cover:
Damage caused by accident, misuse, abuse, or neglect;
Damage caused by operating the product outside the permitted or intended uses;
Damage caused by unauthorized modification, service, or repair;
Cosmetic damage, including scratches and broken plastic;
Products with removed or altered serial numbers.
To make a warranty claim, contact support@detiko.com with your order number and a description of the defect. DETIKO's sole obligation under this warranty is, at our discretion, to repair or replace the defective product.
THIS WARRANTY IS YOUR EXCLUSIVE REMEDY AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED.
6. App, Software & Subscription
6.1 App License
Subject to your compliance with these Terms, DETIKO grants you a limited, non-exclusive, non-transferable, revocable license to download and use the DETIKO mobile application ("App") solely for your personal, non-commercial use with DETIKO products.
6.2 Subscription Services
DETIKO may offer optional paid subscription plans ("Subscription") that provide enhanced features such as extended cloud video storage, AI-powered detection alerts, and multi-camera management. Subscription fees are billed in advance on a monthly or annual basis.
Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period;
You may cancel your Subscription at any time through your account settings.
Subscription fees are non-refundable except where required by law.
DETIKO reserves the right to change subscription pricing with 30 days' notice.
6.3 Software Updates
DETIKO may provide firmware and software updates to improve functionality, security, or performance. Some updates may be applied automatically. Continued use of the product after an update constitutes acceptance of any changes.
6.4 Prohibited Uses
You agree not to:
Reverse engineer, decompile, or disassemble any DETIKO software;
Use the App or Services for any unlawful purpose;
Attempt to gain unauthorized access to DETIKO systems or other users' accounts;
Use DETIKO products to harass, surveil, or harm any individual;
Redistribute or resell DETIKO software or Services without written permission.
7. Privacy & Data
7.1 Data Collection
We collect device information, usage data, and personal data in accordance with our Privacy Policy. Our collection, storage, and use of this data are strictly governed by our Privacy Policy, which is incorporated into these Terms by reference.
7.2 Video & Audio Recording
DETIKO cameras may record video and, where enabled, audio. You are solely responsible for ensuring that your use of recording features complies with all applicable federal, state, and local laws. Depending on your location, you may be required to notify individuals that they are being recorded.
7.3 Cloud Storage
If you use cloud storage features, your recordings are stored on secure servers. Free-tier storage is limited and subject to change. We implement industry-standard security measures but cannot guarantee absolute security. In the event of a data breach that affects your personal information, we will notify you as required by applicable law.
7.4 Data Sharing
DETIKO does not sell your personal data to third parties. We may share data with trusted service providers who assist us in operating our business, subject to confidentiality obligations. We may disclose your information if required by law or to protect the rights, property, or safety of DETIKO, our users, or others.
8. Camera Use & Legal Compliance
DETIKO window cameras—including outdoor, indoor, and bird feeder cameras—are designed to monitor your own property and surrounding areas. You agree to use DETIKO products responsibly and in full compliance with applicable law. Specifically, you agree:
l To use cameras only in locations where you have legal authority to record (e.g., your own property or with proper consent);
l Not to position cameras in a way that intentionally or primarily captures areas where individuals have a reasonable expectation of privacy (e.g., neighbors' bedrooms, bathrooms);
l To comply with all federal and state wiretapping, eavesdropping, and surveillance laws, which may require one-party or two-party consent before recording audio;
l To provide legally required notice to third parties (such as delivery personnel, visitors, or employees) that they may be recorded where applicable;
l Not to use DETIKO products for stalking, harassment, discrimination, or any other illegal purpose;
l To be solely responsible for how your cameras are positioned, what they record, and how that footage is used or shared.
DETIKO assumes no liability for any unlawful use of its products. We reserve the right to cooperate with law enforcement investigations and to comply with valid legal requests for user data.
9. Intellectual Property
All content, trademarks, logos, product names, designs, software, and technology associated with DETIKO products and services are the exclusive property of DETIKO Limited or its licensors and are protected by US and international intellectual property laws.
Nothing in these Terms grants you any ownership interest in DETIKO's intellectual property. You may not use our trademarks, logos, or branding without our prior written consent. Any feedback, suggestions, or ideas you submit to DETIKO may be used by us without obligation or compensation to you.
10. Disclaimer of Warranties
EXCEPT FOR THE LIMITED WARRANTY PROVIDED IN SECTION 5.3, DETIKO PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
DETIKO DOES NOT WARRANT THAT: (A) THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (B) ANY DEFECTS OR ERRORS WILL BE CORRECTED; (C) THE SERVICES WILL MEET YOUR REQUIREMENTS; OR (D) DETIKO CAMERAS WILL DETECT ALL EVENTS OR PREVENT CRIMINAL ACTIVITY, LOSS, OR DAMAGE. DETIKO PRODUCTS ARE NOT A SUBSTITUTE FOR PROFESSIONAL SECURITY SYSTEMS OR EMERGENCY SERVICES.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DETIKO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF DETIKO PRODUCTS OR SERVICES, EVEN IF DETIKO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL DETIKO'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF DETIKO PRODUCTS OR SERVICES EXCEED THE AMOUNT ACTUALLY PAID BY YOU TO DETIKO IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in their entirety.
12. Indemnification
You agree to defend, indemnify, and hold harmless DETIKO and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use or misuse of DETIKO products or services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your recording, sharing, or use of video or audio content captured by DETIKO cameras; or (e) any claim by a third party arising from your use of DETIKO products.
13. Dispute Resolution & Arbitration
13.1 Informal Resolution
Before initiating any formal dispute, you agree to contact DETIKO at support@DETIKO.com and provide a written description of the dispute. We will make good-faith efforts to resolve the matter informally within 30 days.
13.2 Binding Arbitration
If the dispute cannot be resolved informally, you and DETIKO agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of DETIKO products or services (except for small claims court actions) shall be resolved through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall take place in Delaware, or at another mutually agreed location, and the arbitrator's decision shall be final and binding.
13.3 Waiver of Class Actions
YOU AND DETIKO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF REPRESENTATIVE OR CLASS PROCEEDING.
13.4 Opt-Out
You have the right to opt out of binding arbitration within 30 days of first accepting these Terms by notifying us in writing at support@DETIKO.com with the subject line "Arbitration Opt-Out."
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. For any disputes not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Delaware.
15. Modifications
DETIKO reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and, where practicable, notifying you via email. The updated Terms will indicate the effective date. Your continued use of DETIKO products or services after the effective date constitutes your acceptance of the revised Terms.
We also reserve the right to modify, suspend, or discontinue any aspect of our products or services at any time, with or without notice, and without liability to you.
